Snap Count — Terms of Service
These Terms of Service ("Terms") are a legal agreement between you ("you," "your," or "Coach") and G-Cubed Creations LLC ("we," "us," or "our"), the provider of Snap Count (the "App"), available at getsnapcount.com.
By purchasing, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What the App does
Snap Count is a tool that lets a coach or team administrator record which players are on the field for each play of a youth football game, and view the resulting participation counts and percentages. That is its entire function. It is a record-keeping aid and nothing more.
This is not a school service. Snap Count is sold directly to individual coaches, team parents, and league volunteers for use with recreational and travel teams. It is not provided under contract with, or for the benefit of, any school or school district, and is not intended to be used by school staff in an official school capacity. Because of that, Snap Count is not subject to FERPA (the federal law governing school education records) or Illinois's SOPPA or similar state student-data laws, which apply only to school-contracted services. If you are a school employee, do not use the App as an official school system of record — use it, if at all, only in a personal or volunteer capacity, separate from your school role.
2. What information the App holds
Data we collect. With your explicit input, the App stores: player first and last names (or initials/nicknames, if you choose — see Section 3), jersey numbers, play-by-play participation records (who was on the field for each play, and derived counts/percentages), and whether a player was marked unavailable for a given game (a simple unavailable/available administrative flag — see Privacy Policy Section 2(b)). If you use the Utility screen's "Save a backup now" feature, that same information is saved into a backup file on your own device for you to restore later or move to another device — we do not receive or store a copy of it ourselves. That is the entire list.
Data we do not collect. The App does not collect, and has no feature for entering: photos or video of any player; birthdates; home addresses; phone numbers or email addresses for any player; location data; biometric data of any kind (no facial recognition, fingerprints, or similar); or player or parent accounts of any kind. Only you, the coach or team administrator, hold an account. No player or parent ever logs in, registers, or interacts with the App directly.
Retention and deletion. Your roster and game data are retained for as long as your account is active, so that season history remains available to you. You can delete an individual player, an entire roster, or an entire team at any time from within the App, and that deletion takes effect immediately. If you cancel or let your trial or subscription lapse, see Section 5 for what happens to your access (short version: your data is kept intact and is never deleted just because you stopped paying, even though the App itself locks after the 30-day grace period until you renew). If you close your account entirely or ask us in writing to delete your data, we will delete it within 30 days, except where we are required to keep limited records (such as billing records) for legal or accounting purposes.
3. Your responsibility for player information — please read this section carefully
The App lets you enter player names, jersey numbers, and participation records. You decide what information to enter. We do not require you to enter any player's real name.
You agree that you are solely and entirely responsible for:
(a) Verifying that your use of player names is permitted. Before entering any player's name into the App, it is your responsibility to check and comply with the rules, policies, bylaws, codes of conduct, and child-safety and privacy requirements of:
- your league, club, association, or governing body;
- your school or school district, if applicable;
- your city, county, state, and any other applicable jurisdiction; and
- any applicable federal law.
(b) Obtaining any consent or permission required. You are responsible for obtaining, in advance, whatever permission your league or applicable law requires from each player's parent or legal guardian before entering that player's information into the App, and for honoring any request to withdraw that permission.
(c) Having the authority to enter the information. You represent and warrant that you are at least 18 years old, that you are acting in an authorized capacity for your team (such as a coach, assistant coach, team parent, or league official), and that you have the authority to enter and use the information you put into the App.
(d) What you do with the output. You are responsible for how you share, publish, post, print, distribute, or discuss any statistics, screenshots, exports, or reports the App produces, including whether doing so is permitted by your league and applicable law.
(e) The accuracy of the records. You are responsible for recording plays accurately and for verifying any count before relying on it. See Section 7.
We do not review, monitor, approve, or verify the information you enter, and we do not know and cannot determine what your league or jurisdiction requires. Determining that is your job, not ours.
You may use initials, nicknames, or jersey numbers alone instead of full names. If you are unsure whether your league permits the use of full names, we encourage you to do this.
4. Children
The App is not directed to children, and children are not permitted to create accounts or use the App directly. Every account is held by an adult coach or team administrator. No child ever registers, logs in, downloads the App onto their own device as a user, or provides any information to us directly — every piece of information about a player is typed in by the adult account holder, on the team's behalf, under Section 3, not collected by us from the child. We do not knowingly collect personal information directly from any child, and we have no reason to believe any child interacts with the App as a user.
Any information about a minor that appears in the App is information you chose to type in. Our Privacy Policy explains how that information is handled, including the data list in Section 2.
5. Your account, your subscription, and your purchase
Three paid plans: Standard, Pro, and All-Star. There is no free plan — every account requires an active subscription, except for a free trial under a promo code as described below.
- Standard — $7.99 per year, per coach. One team roster, unlimited preset lineups, This Game stats, and Level 1 Swap substitution (substitute anyone for anyone).
- Pro — $8.99 per year, per coach. Everything in Standard, plus two team rosters, position tags on every player (Offense / Defense / Special Teams), Level 2 position-filtered swapping (substitute within a position group), Season and week-by-week stats, and CSV export.
- All-Star — $9.99 per year, per coach. Everything in Pro, plus three team rosters, per-player designated Sub assignments, Level 3 one-tap filtered substitution using those designated subs, Run/Pass play tracking with a Team stats view, and a season Wins/Losses record.
Billing for all three plans runs through our payment processor, Stripe. Additional paid features may be offered separately in the future, and if so, their pricing will be disclosed before you're charged.
Promo codes and free trials. Creating an account does not require a promo code — anyone may create an account and subscribe to any plan directly. If you do have a one-time promo code, entering it when you create your account unlocks every plan free for a 90-day trial, with no payment taken up front. Once a trial ends, the same renewal and grace-period process described below applies, exactly as if a paid subscription had lapsed.
Auto-renewal. A paid subscription automatically renews each year on your purchase anniversary at the then-current price, unless you cancel before the renewal date. We will email you a reminder to the most recent address on your account approximately seven (7) days before each renewal charge, so a year-later charge is never a surprise. The subscription renews on schedule whether or not that email is actually received (for example, if it's misdirected by your email provider or your address is out of date), except where applicable state law requires otherwise — in that case, we will comply with that law's notice and renewal requirements, including any additional notice period or actual-receipt condition it requires before you may be charged.
How to cancel. You may cancel at any time through the account portal linked in the App or emailed to you at signup (a Stripe-hosted customer portal). Cancelling stops future renewal charges; it does not refund the current subscription period except as stated below.
What happens if your trial or subscription lapses — a 30-day grace period, then full lockout. If a free trial ends, or a subscription is not renewed (payment fails and is not corrected, or you cancel), the App shows an in-app message asking you to renew. For the next 30 days (the "grace period"), your account keeps full, unrestricted access — nothing changes functionally during this window. If the account is not renewed before the grace period ends, the App locks completely: every screen is blocked, including your previously recorded rosters, games, and stats, until you renew. Your data is never deleted for nonpayment — locking out access is not the same as losing your data, and everything becomes available again the moment you renew.
Renewing after a lapse. If you renew during the grace period or after being locked out, your new one-year term is calculated from the date your prior trial or subscription actually expired, not from the date you pay — a later renewal does not add any bonus days to your new term.
Payment failures. If a renewal payment fails, we (through Stripe) will attempt to collect it again automatically over a period of time, and may prompt you to update your payment method. If payment is never successfully collected, the grace period and then the lockout described above apply the same as any other lapse; it does not happen on the first missed attempt.
We own the App. We and our licensors retain all right, title, and interest in and to the App, including all related intellectual property rights (software, design, text, graphics, trademarks, and the Snap Count name and logo). These Terms grant you only a limited, personal, non-transferable, revocable license to use the App as permitted by your subscription plan, and no ownership interest in the App is transferred to you.
Your license is personal to you and non-transferable. You may not resell, sublicense, rent, or share your access with others, except as expressly permitted by a feature we provide for that purpose (such as a future shared-access feature for assistant coaches).
You are responsible for keeping your login credentials secure and for all activity under your account.
Refunds: All charges are final. We do not offer refunds for a change of mind, non-use, or dissatisfaction, for either the initial charge or an annual renewal charge. The only exception is a verified double charge — if you were charged twice for the same subscription period, email snapcountsupport@gmail.com and, once we confirm it, we will refund the duplicate charge.
6. Acceptable use
You agree not to:
- use the App for any unlawful purpose, or in violation of any league or school policy;
- enter information about any person without the authority to do so;
- use the App to harass, embarrass, target, or single out any child;
- attempt to access another user's account or data;
- copy, decompile, reverse engineer, or redistribute the App; or
- resell access to the App.
We may suspend or terminate your access, without refund, if we reasonably believe you have violated these Terms.
7. No warranty — the App is provided "as is"
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
Without limiting the above, we do not warrant that:
- the App will be uninterrupted, available at any given time, error-free, or free of defects;
- counts, percentages, or any other figure the App produces will be accurate or complete;
- data you enter will be preserved, backed up, or recoverable; or
- the App will satisfy the requirements of your league, your governing body, or any law.
The App is not an official system of record. It does not certify, guarantee, or prove compliance with any minimum-play rule, participation requirement, or league regulation. If your league requires official records, keep them separately. Do not rely on the App as your only record.
You are responsible for maintaining your own backup of any information that matters to you.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR REPUTATIONAL HARM, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, EXCEPT THAT THIS LIMIT DOES NOT APPLY TO YOUR INDEMNIFICATION OBLIGATIONS UNDER SECTION 9.
This includes, without limitation, any claim arising from or relating to:
- your entry, storage, display, sharing, or publication of any player's name or information;
- any dispute with a parent, guardian, player, coach, team, league, school, or governing body;
- any finding that your use of the App violated a league rule, school policy, or any law;
- any inaccuracy in a count, percentage, or report; or
- any loss, corruption, or unavailability of data.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless G-Cubed Creations LLC and its owners, officers, employees, contractors, and agents from and against any and all claims, demands, actions, investigations, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- your use of the App;
- any information you entered into the App, including any player's name or personal information;
- your failure to obtain any required parental or guardian consent;
- your violation of any league, club, school, city, county, state, or federal rule, policy, or law;
- your publication or sharing of any statistics, screenshots, or reports produced by the App; or
- your breach of these Terms or of any representation or warranty you make in them.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense of such claims.
10. Availability, changes, and discontinuation
(a) We may change the App. We may modify, suspend, add to, or remove any feature of the App at any time. We may update the App automatically; by using the App you consent to receiving those updates.
(b) No guaranteed term of service. Your purchase is a license to use the App as it exists, for as long as we choose to offer it. It is not a guarantee that the App will remain available for any particular period of time. We are not obligated to operate, host, maintain, or support the App indefinitely, and we may stop doing so for any reason, including that it is no longer commercially viable for us to continue.
(c) Shutting the App down. We may permanently discontinue the App at our sole discretion. If we do:
- we will use reasonable efforts to give you at least 30 days' notice by email to the address on your account and by notice on getsnapcount.com;
- during that notice period you will be able to export your data from the Stats screen; and
- after the shutdown date, the App will stop functioning, your data may be permanently deleted, and access will not be restored.
You are responsible for exporting and keeping your own copy of any data you need. We are not obligated to retain or return your data after the shutdown date.
(d) Refunds on shutdown. If we permanently discontinue the App, we may, at our sole discretion, offer a refund to users who purchased recently. Any such refund is discretionary and is not an admission of liability. Except where required by law, you are not entitled to a refund, a pro-rated refund, credit, replacement, compensation, or damages of any kind because the App is discontinued, suspended, unavailable, or changed. Your remedies are limited as set out in Sections 7 and 8.
(e) Suspension of your access. We may suspend or terminate your individual access at any time if you breach these Terms, if we suspect fraud or a chargeback, or if required by law. If we terminate your access for cause, we may also delete your account data, and we have no obligation to retain, export, or return it to you.
11. Changes to these Terms
We may update these Terms. If we make a material change, we will update the "Last updated" date above and take reasonable steps to notify you, such as a notice in the App or an email, at least 30 days before the change takes effect. Continuing to use the App after the change takes effect means you accept the revised Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules.
(a) Agreement to arbitrate. Except for a claim that qualifies for small-claims court, or a claim for injunctive relief to stop unauthorized use of the App, you and we agree to resolve any dispute arising out of or relating to these Terms or the App through binding individual arbitration, not in court, administered under the consumer arbitration rules of a recognized arbitration provider (such as the American Arbitration Association), and conducted in Summit County, Ohio, or another mutually agreed location, or by video/phone if the arbitrator permits.
(b) Class action waiver. Any arbitration or permitted court proceeding will be conducted only on an individual basis. You and we each waive any right to bring or participate in a class, collective, or representative action. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court, and the rest of this arbitration agreement remains in force for all other claims.
(c) How you accept this clause. This arbitration agreement is part of these Terms, and you accept it the same way you accept the rest of these Terms — by purchasing, installing, accessing, or using the App, as described at the top of these Terms. No separate or standalone acceptance step is required. If you do not want to be bound by this arbitration agreement, use the opt-out procedure in Section 12(d) below.
(d) Opt-out. You may opt out of this arbitration agreement by emailing snapcountsupport@gmail.com within 30 days of first accepting these Terms, stating that you opt out of arbitration. If you opt out, disputes will instead be brought exclusively in the state or federal courts located in Summit County, Ohio, and you consent to personal jurisdiction there.
13. Miscellaneous
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App, and supersede any prior understanding.
Severability. If any provision is held unenforceable, the rest remains in effect and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a sale or transfer of the business.
A note on other states' privacy laws. Because of our size and the limited data described in Section 2, we believe certain state privacy laws that apply only above a certain number of users or a certain revenue level (for example, California's CCPA/CPRA, Virginia's VCDPA, and Colorado's CPA) do not currently apply to us. If our business grows enough that one of those laws applies, or if we determine that assessment was incorrect, we will update this Terms of Service and our Privacy Policy to comply with it.
Survival. Sections 3, 7, 8, 9, 10(b)–(d), 12, and 13 survive any termination of your access or any discontinuation of the App.
